The Uinta County Commissioners met in regular session on December 5, 2023 in the commission chambers, 225 9th Street, Evanston. Chairman Mark Anderson convened meeting at 2:00 p.m. Commissioner Eric South and Commissioner Brent Hatch were present.   Also present:  Amanda Hutchinson, County Clerk.

Agenda

Motion South, second Hatch to approve the agenda amended to include Jason Lamberti with a road request, and the commissioners with a resolution regarding usage of the courthouse.  3 yes votes, passed.

Fort Bridger Airport

Motion Hatch, second South to approve three requests for reimbursement for AIP 17, AIP 18, and AIP 19 for the Fort Bridger Airport Taxiway and Apron Reconstruction Project as requested by Taylor Kofoed, JUB Engineers.  3 yes votes, passed.

CSBG Sub-Recipient Agreements

Motion Hatch, second South to approve Community Services Block Grant (CSBG) Sub-Recipient Agreements between the Uinta County Board of Commissioners in conjunction with the Community Services Block Grant Board of Directors and the Evanston Boys and Girls Club of Wyoming for $20,000, DIU of Uinta County for $18,000, and SAFV Task Force for $15,000 as requested by Rebecca Osterberg, Human Services.  3 yes votes, passed.

2024 Holiday Schedule

Motion South, second Hatch to approve the 2024 Holiday Schedule as presented by Amanda Hutchinson, County Clerk.  3 yes votes, passed.

Road Maintenance Request

Jason Lamberti came before the Commissioners to request that an additional 5 miles of County Road 284 be plowed to allow access to cabins and recreational opportunities.  He also requested that County Road 243 (Taylor Lane) be paved saying he believed it would provide more business to Lyman and allow more opportunities for growth.  Dustin Henstra, Road and Bridge Foreman stated that County Road 284 is an all day project that would likely not be possible due to the Road and Bridge staffing shortage.  He is also thinking about making County Road 243 a gravel road again to provide easier maintenance.  The Commissioners proposed having a meeting with the Forest Service regarding County Road 284.

Courthouse Resolution

Motion South, second Hatch to approve Resolution 23-41 Declaring that the County Courthouse is not an Open Forum.  Effective January 1, 2024 no person should assemble, protest, congregate, or petition inside the Uinta County Courthouse.  3 yes votes, passed.

EVANSTON CITY COUNCIL

First Regular Meeting

December 5th, 2023

The official record of proceedings of the first regular meeting of the Evanston City Council for the month of December was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded.

Council member Sellers led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, Mike Sellers and Jen Hegeman. Council member Welling was excused.

Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Director of Parks and Recreation, Kim Larson; Community Development Director, Rocco O’Neil; Police Chief, Mike Vranish; Public Works Director, Gordon Robinson; City Engineer, Dean Barker and Police Sergeant, Ken Pearson.  Information Technology Coordinator, Preston Sheets was excused.  A group of interested citizens was also present.

Council Comments

Council member Lind commented that there were many events last week to attend including the Light Parade, Winter Meeting, Jingle Bell Jaunt, Festival for Families, and the old Wyoming State Hospital Preservation meeting. He commented that they were all great events.

Council member Sellers reminded everyone to shop local. He also commented to make sure to notice people that are struggling, as this time of year can be hard. He also reminded everyone that the money that is donated to the Salvation Army bell ringers stays in the community.

Council member Hegeman thanked all who attended the Save the Wyoming State Hospital Rally. She also mentioned how much she enjoys the Light Parade downtown.

Mayor Williams thanked everyone that help with all the events that were held last week. He commented that he agreed with Council member Sellers about the Salvation Army and what a great organization it is. 

Oath of Office

Mayor Williams conducted an Oath of Office for Chad C. Carson to fill the position of Police Officer for the Evanston Police Department.

Public Hearing/Liquor License

City Attorney Mark Harris conducted a public hearing to receive public comment regarding an application for a transfer of ownership of a Restaurant Liquor License from Main Street Deli, LLC dba: Main Street Deli; to the Bakery, LLC dba: The Bakery.  Alex Rossi owner of The Bakery addressed the Council.   No one else addressed the issue and Mr. Harris closed the hearing.

Transfer of Restaurant Liquor License

Council member Lind moved, Council member Perkes seconded, to approve the transfer of ownership of a Restaurant Liquor License from Main Street Deli, LLC dba: Main Street Deli; to The Bakery, LLC dba: The Bakery, but to withhold issuance of the License pending receipt of a Food Service Permit from the State of Wyoming.

Consent Agenda

Council member Lynch moved, Council member Lind seconded, to approve the following Consent Agenda Items:

Parade Route Permit requested by the Evanston Police Officers Association for the Annual Shop with a Cop Parade on Saturday, December 16, 2023, beginning at 7:30 a.m. at the Hampton Inn and ending at Walmart.

CALL FOR BIDS

Tenant Grey Shell and Exterior Parking and Loading Facilities

 The City of Evanston, Wyoming, is seeking qualified and experienced contractors to submit proposals for a Tenant Improvement vanilla buildout project. The project involves the interior renovation and exterior site improvement of the Historic Roundhouse Building in downtown Evanston, Wyoming. We invite your company to participate in this competitive bidding process. The selected contractor will oversee the overall tenant improvement project, excluding the specialty interior finishes of the tenant space.

Work consists of coordination and management of the build-to-suit tenant space completion (Grey Space), minus the specialty tenant finishes and equipment installation. Interior demo and construction, concrete slab and footings, mechanical, electrical, plumbing, public restrooms, exterior work to include service yard, north parking lot, loading dock, overhead door, service door, equipment pads, and other work defined in the instruction to bidders.

Copies of the bidding documents are available and open to public inspection in the office of the Owner, City of Evanston, 1200 Main Street, Evanston, WY 82930, and the office of MJSA Architects,

255 South 700 West, Salt Lake City, UT 84101. Paper plans and specifications will not be distributed. Bidders must obtain plans as managed by MJSA/Architects by contacting Perry Martin, PMartin@mjsaa.com. 

A pre-bid virtual conference will be held on December 1, 2023, at 10:00 AM MST. The link will be provided in the bid documents.

All proposals must be accompanied by a Bid Bond or Cashier’s Check in the amount of ten percent (10%) of the maximum amount of the proposal.  The successful bidder shall provide a 100% Performance and Payment Bond.  Preference will be given to Wyoming Contractors as defined by Wyoming Statutes Section 16-6-101, et seq.  Bidders are required to comply with all applicable local, state, and federal laws.

The Owner reserves the privilege of rejecting any or all proposals or waiving any irregularities or formalities in any proposal in the bidding.  Submit written proposals to Community Development, City of Evanston, 1200 Main Street, Evanston, WY 82930.  Sealed proposals shall be marked “RH Grey Shell Package for Shades of Pale” and state the name of the company bidding on the outside of the envelope. Notice is hereby given that the Wyoming Department of Transportation has accepted as completed according to plans, specifications and rules governing the same work performed under that certain contract between the State of Wyoming and WS Construction, LLC, The Contractor, on Highway Project Number BLD6448 in Uinta County, consisting of POE roof replacement, and the Contractor is entitled to final settlement therefore; that the Director of the Department of Transportation will cause said Contractor to be paid the full amount due him under said contract on January 16, 2024.

NOTICE TO SOLICIT NOMINATIONS FOR DIRECTORS OF UINTA COUNTY WEED & PEST CONTROL DISTRICT

Appointments to the Uinta County Weed & Pest Control District will be made on Tuesday, January 2, 2024, by the Board of Uinta County Commissioners at the County Complex, 225 9th Street, Evanston, Wyoming.

Pursuant to the Wyoming Weed and Pest Control Act of 1973 (W.S. 11-5-101 through 11-5-303), notice is hereby given to solicit nominations for appointments to Uinta County Weed & Pest Control District. Appointments shall be made in accordance with W.S. 11-5-104.

 Interested applicants should contact Chris Aimone at 57 Patriot, Evanston.

A total of one director to fill an unexpired term:

 One (1) from School District #4  

Prior to appointment, nominees shall submit a petition signed by at least ten (10) landowners to the office of the County Commissioners at least five (5) days before the date of the meeting or before December 27, 2023.

NOTICE IS HEREBY GIVEN that a sworn application has been made for a decree in the Third Judicial District Court in and for Uinta County, State of Wyoming, establishing in Janette Kent, the right and title to the decedent’s interests in real property, whether herein enumerated or not, including without limitation all fee interests, working interests, royalty interests, overriding royalty interests, production payments, net profits interests, and other payments out of production, situate in Uinta County, State of Wyoming.  For a complete listing of such identified lands, a copy of the application may be acquired at the Uinta County District Court, Docket No. 2023-CV-109.

If no objection to the application has been filed within thirty (30) days of the first date of publication of this Notice, the Court shall enter a decree establishing the right and title to the aforementioned property located in Wyoming.

NOTICE OF ACCEPTANCE OF AND FINAL SETTLEMENT

To all persons, firms, or corporations who have any claim for any work done for, or any material furnished to Kilgore Companies, LLC dba Lewis and Lewis, Inc. for the construction of Street Overlay Project 2023 located in Evanston, WY. You are hereby notified that the City of Evanston, Wyoming has accepted as completed, according to the plans and specifications and rules set forth in the contract between the City of Evanston and the aforesaid contractor, the work in connection with the construction of the above, and that said contractor is entitled to final settlement therefore.

You are further notified that upon the 16th of January, 2023, being at least 40 days after the first publication of this notice, the City of Evanston will pay the full amount due under said Contract; and in the event that your claim is not filed with the City Clerk of said City prior to said 16th day of January, 2023, the same shall be waived.

This notice is given pursuant to Section 15-1-113 (h), Wyoming Statutes.
