THIS MATTER came before the Court on the Petition of Charles Linn to Set Over Exempt Property, filed by the administrator of the estate, Charles Linn, with this Court on July 17, 2020, the Request for Order Granting Petition of Charles Linn to Set Over Exempt Property filed by Mr. Linn on March 18, 2024, the Contest of Final Account filed by heir to the estate, Emily Farley, on March 18, 2024, and the Administrator's Motion for Scheduling Conference and Issuance of Scheduling Order filed by Mr. Linn on March 19, 2024.

WHEREFORE IT IS HEREBY ORDERED that a hearing on the Petition of Charles Linn to Set Over Exempt Property shall be heard on the 13th day of May 2024, in the Uinta County District Court, beginning at 2:00 p.m. All persons interested may appear to show cause why the exempt property should not be set over to Mr. Linn. The administrator may now publish this order once in a newspaper of general circulation in the county in which the probate is pending, and mail a copy of this order to each heir and beneficiary of the estate pursuant to Wyoming Statute § 2-7-505.

IT IS FURTHER ORDERED that the Court will hear the Contest of Final Account at the show cause hearing.

First Regular Meeting

March 19th, 2024

The official record of proceedings of the second regular meeting of the Evanston City Council for the month of March was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live.

Council member Perkes led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, Dave Welling, Mike Sellers and Jen Hegeman. 

Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Clerk, Diane Harris; Director of Parks and Recreation, Kim Larson; City Engineer, Damon Newsome; Information Technology Coordinator, Preston Sheets, and Police Chief, Mike Vranish and Senior Planner, DuWayne Jacobsen. Public Works Director, Gordon Robinson. City Treasurer, Trudy Lym and Community Development Director, Rocco O’Neill were excused.   A group of interested citizens was also present.

The Uinta County Commissioners met in regular session on March 19, 2024 in the commission chambers, 225 9th Street, Evanston. Chairman Mark Anderson convened meeting at 2:00 p.m. Commissioner Eric South and Commissioner Brent Hatch were present. Also present:  Amanda Hutchinson, County Clerk; and Andy Kopp, Sheriff.

Agenda

Motion South, second Hatch to approve the agenda amended to include McKenna Julian with a Youth Ag request, and to postpone the Law Enforcement Service Agreement. 3 yes votes, passed.

Industrial Siting MOU

Motion Hatch, second South to approve a Memorandum of Understanding (MOU) with various Counties, Cities, and Towns in Southwest Wyoming to determine an amount and schedule for payment and distribution of impact assistance funds relating to the Project West Soda Ash project.  3 yes votes, passed.

Dust Suppression

Motion South, second Hatch to approve an agreement with Dustbusters for $335,946.00 to apply dust suppressant on certain county roads using CMAQ grant funds and a county match as requested by Saralee Gross, Road and Bridge.  3 yes votes, passed.

Motion Hatch, second South to approve an agreement with Dustbusters for $109.50 per ton of dust suppressant using CMAQ grant funds as requested by Saralee Gross, Road and Bridge.  3 yes votes, passed. 

Hangar Rental Deposits

Motion Hatch, second South to apply Fort Bridger Airport Hangar Lease deposits made in 2012 to current rental payments as requested by Jeff Breininger, Maintenance.  3 yes votes, passed.

WYDOT MOU

Motion Hatch, second South to approve a Cooperative Agreement with the Wyoming Highway Patrol for the Sheriff’s Department to assist with road closure gate duties for $50.00 per hour per employee through May 2026 and the total not to exceed $50,000 as requested by Andy Kopp, Sheriff.  3 yes votes, passed.

Emergency Management MOU

Motion South, second Hatch to approve a Memorandum of Understanding (MOU) between Uinta County Public Health, Uinta County Emergency Management, and the Uinta County School District #1 to provide access to UCSD #1 owned buildings, properties, and transportation services in a time of emergency as presented by Josh Rasnake, Emergency Management.  3 yes votes, passed.

L & C Subdivision

Kent Williams, Planner, opened a public hearing to allow for comments on the L & C Subdivision, a three lot, Residential zoned subdivision of Lot 15 Block 4 of the Riverside Ranches Subdivision located in Section 24, T16N R115W.  Eric Wall, Uinta Engineering and Surveying, spoke in favor; no one spoke in opposition. Motion South, second Hatch to approve Resolution 24-07 authorizing the L & C Subdivision.  3 yes votes, passed.

Fencing Resolution

Motion South, second Hatch to not approve a resolution authorizing an amendment to the Resolution for the Subdivision of Land for Uinta County (Resolution 19-23) to include a requirement that a plan for perimeter fencing be included in a subdivision proposal unless certain conditions exist and apply as presented by Williams.  3 yes votes, passed.

Special Prosecution

Motion Hatch, second South to approve Resolution 24-08 authorizing Sarah Chavez Harkins with the Carbon County Attorney’s Office to act as special prosecutor in Uinta County in a case with local conflict of interest as requested by Amanda Hutchinson, County Clerk.  3 yes votes, passed.

Final Proof of Loss

Motion South, second Anderson to approve the Final Proof of Loss for $2,875.00 for fire damage to the Bridger Valley Transfer Station as requested by Hutchinson.  3 yes votes, passed.

Deferred Compensation Resolution Amendment

Motion South, Hatch to approve Resolution 24-09 amending the Uinta County, WY Deferred Compensation Plan to authorize transactions with any two signatures of the trustees for transactions of Mainstay Funds as requested by Hutchinson.  3 yes votes, passed.

Notice is hereby given that on the 5th day of March, 2024 a representative from The Store Fort Bridger, LLC filed in the office of the Uinta County Clerk, an application to transfer the ownership of a retail liquor license currently owned by Fort Bridger Cash Store, LLC dba Fort Bridger Cash Store, licensed premise is located at 37066 Business Loop I-80, Fort Bridger.  Protests, if there be any, against transferring the license to the new owners will be heard at 2:00 p.m. on the 16th day of April, 2024 in the County Commission Chambers, 225 9th Street, Evanston, Wyoming.

NOTICE OF APPLICATION

NOTICE IS HEREBY GIVEN that on the 13th day of March, 2024, Michael. McMurtrey Jr. filed an Application for a Decree of Summary Distribution of Real Property seeking an establishment in the name of Michael McMurtrey Jr. and Bryan R. McMurtrey, of the decedent’s right, title and interest in and to certain real property located in Uinta County, Wyoming, and more particularly described as follows:

Lot 1 in Block 1 of The Ranch IV Addition to the City of Evanston, Uinta County, Wyoming, according to plat recorded August 15, 2008, Instrument No. R144324 in the office of the Uinta County Clerk.

Together with water rights, all improvements thereon and appurtenances thereto belonging; and subject to all reservations of record.

SUBJECT, HOWEVER, to all reservations, restrictions, exceptions, easements and rights-of-way of record.

If no objection to the Application has been filed within thirty (30) days of the first date of publication of this Notice, the applicant will request that the Court enter a decree establishing in them all right, title and interest in and to the above described real property.

INVITATION TO BID

Sealed bids for Evanston Housing Authority, City of Evanston Hawpatch Window Replacement Project located at Hawpatch Lane off of City View Drive will be received until 2:00 P.M. on April 10, 2024 and then publicly opened and read aloud at the Evanston Housing Authority office located at 155 Apache Dr.

This project includes 150 (bidder to verify) windows in 14 duplexes.

Bidding Documents are available at the Evanston Housing Authority office or can be emailed to interested bidders. Email david@evanstonhousing.org for information.

The work shall include all labor, material, equipment, and quality control necessary to complete the turnkey project which includes removal and disposal of old windows. Install new and apply insulating foam and caulk inside and out, and clean up al debris.

Work shall also include, but is not limited to, all incidental items required for the materials to be installed to the material manufacturer’s requirements and the contract documents. Work at the site may begin spring of 2024.

Each bidder will be required to submit, with their bid, a certified check, or Bid Bond made payable without condition to the Evanston Housing Authority in the amount of not less than five percent (5%) of the Bidder’s maximum Bid Price as a guarantee that such Bidder will enter into a contract within five (5) days after the date of the OWNER’S Notice of Award.

This project will comply with the Davis-Bacon Act.

Evanston Housing Authority reserves the right to reject any or all bids, or any part of any bid and to waive any formality in any bid, as its best interest may appear.
