FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest has occurred under the terms of a Promissory Note (the “Note”) dated December 21, 2011, executed and delivered by Kenny A. Baker and Stephanie Baker (“Mortgagors”) to U.S. Bank National Association , N.D., and a real estate Mortgage (the “Mortgage”) of the same date securing the Note, which Mortgage was executed and delivered by said Mortgagors, to said Mortgagee, and which Mortgage was recorded on April 5, 2012, at Reception No. R158684, in Book 978, at Page 825-831 in the public records in the office of the County Clerk and ex-officio Register of Deeds in and for Uinta County, State of Wyoming; and

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage as of January 2, 2020 being the total sum of $109,166.79, plus interest, costs expended, late charges, and attorneys’ fees accruing thereafter through the date of sale;

WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid;

WHEREAS, if the foreclosure sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of his/her/its money paid.  The Purchaser shall have no further recourse against the Mortgagee, Mortgagor, Servicer or their attorneys;

NOW, THEREFORE U.S. Bank National Association as successor by merger of U.S. Bank National Association N.D., as the Mortgagee, will have the Mortgage foreclosed as by law provided by causing the mortgaged property to be sold at public venue by the Sheriff or Deputy Sheriff in and for Uinta County, Wyoming to the highest bidder for cash at 10:00 o’clock in the forenoon on February 12, 2020 at the information desk at the Uinta County Courthouse located at 225 9th Street, Evanston, WY 82930, for application on the above described amounts secured by the Mortgage, said mortgaged property being described as follows, to-wit:

Together with all improvements thereon situate and all fixtures and appurtenances thereto.

Second Regular Meeting

January 21, 2020

The official record of proceedings of the second regular meeting of the Evanston City Council for the month of January was held in the Council Chambers of City Hall on the above date.  These proceedings were video recorded.

Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers, and Mikal Welling.

Staff members present at the start of the meeting were:  City Attorney, Dennis Boal; City Clerk, Nancy Stevenson; City Treasurer, Trudy Lym; Community Development Director, Rocco O’Neill; Director of Engineering & Planning, Dean Barker; Public Works Director, Gordon Robinson; and Police Patrol Lieutenant, Mike Vranish.   Police Chief, Jon Kirby and Director of Parks and Recreation, Scott Ehlers were excused.  A  group of interested citizens were also present.

Council Comments

Councilmember Sellers thanked Arts Inc., and Sage Brush Theater for the productions they recently held in Evanston.  Mr. Sellers also asked everyone to be mindful of those around them that may be struggling and in need of support.

Public Hearing/Liquor License

City Attorney Dennis Boal conducted a public hearing to receive public comment regarding an application to transfer the ownership of a Retail Liquor License from BK Management, LLC., dba: BK Management to SUMO WY, Inc., dba: Ichiban Japanese Steakhouse.  Jerry Zhang, spokesperson for SUMO WY explained the reason for the transfer and that they would be opening a restaurant and bar.   Dharmesh Ahir, owner of the BK Management, LLC., explained that he has leased the building to SUMO Wy, Inc., for their restaurant and bar.  No one else addressed the issue and the hearing was closed.

Transfer/Liquor License/BK Management

Councilmember Lynch moved, Councilmember Perkes seconded, to approve the transfer of ownership of a Retail Liquor License from BK Management, LLC., dba: BK Management to SUMO WY, Inc. dba: Ichiban Japanese Steakhouse.   The motion passed unanimously with 7 yes votes:   Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling.

Final Acceptance/Aspen School Project

Councilmember Ottley moved, Councilmember M. Welling seconded to authorize final acceptance and payment of retainage to Maxfield Construction, Inc., for the Evanston Aspen Elementary School Project.  The motion passed unanimously with 7 yes votes:   Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling.

Resolution 20-03

Councilmember Perkes introduced Resolution 20-03.  Councilmember Perkes moved, Councilmember Sellers seconded, to adopt Resolution 20-03.

RESOLUTION 20-03:  RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE ACCEPTANCE AND EXECUTION OF A PROPOSAL AND AGREEMENT FOR SERVICES  WITH TERRACON CONSULTANTS, INC. TO PROVIDE A PHASE 1 ENVIRONMENTAL SITE ASSESSMENT OF LOT 1   OF BLOCK 2 OF THE UNION CENTER 2ND ADDITION TO THE CITY OF EVANSTON, WYOMING.

Councilmember D. Welling introduced Resolution 20-04.  Councilmember D. Welling moved, Councilmember Lynch seconded, to adopt Resolution 20-04.

RESOLUTION 20-04:  RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A MEMORANDUM OF UNDERSTANDING BETWEEN B.E.A.R (BETTER ENVIRONMENT AND RIVER) PROJECT, INC., AND THE CITY OF EVANSTON TO FACILITATE THE DEVELOPMENT OF THE BEAR RIVER GREENWAY.

Comments/Remarks

Dennis Boal thanked the Mayor and Councilmembers for his appointment and stated that he is looking forward to working another year with the Mayor, Council and Department Heads.
