NOTICE OF PUBLIC HEARING

A public hearing will be held on Tuesday, January 21, at 5:30 p.m. at City Hall, 1200 Main Street, Evanston, Wyoming to solicit public comments regarding a proposed Business Ready Community Planning Grant from the Wyoming Business Council. The City is seeking planning grant funds to create a detailed, comprehensive economic development master plan for the City of Evanston. First Regular Meeting

January 7th, 2025

The official record of proceedings of the first meeting of the Evanston City Council for the month of January was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live.

Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.

Oaths of Office

City Clerk, Diane Harris conducted the Oaths of Office for newly elected Council members: Henry Schmidt, Ward 1; Mike Sellers, Ward 2 and Evan Perkes, Ward 3.

The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Henry Schmidt, Jesse Lind, Evan Perkes, Dave Welling, Mike Sellers and Jen Hegeman.

Council members congratulated the newly elected and re-elected Council members and welcomed Council member Schmidt.  The newly elected and re-elected Council members thanked the voters.

Executive Session

Councilmember Hegeman moved, Councilmember Lind seconded, to go into Executive Session to consider the appointment, employment, right to practice or dismissal of a public officer, professional person or employee.  The motion passed with 5 yes votes:  Schmidt, Lind, Perkes, Sellers, Hegeman.  2 no votes: Williams, Welling.

Councilmember Sellers moved, Councilmember Hegeman seconded, to reconvene the regular meeting  from Executive Session.  The motion passed unanimously with 7 yes votes:  Williams, Schmidt, Lind, Perkes, Welling, Sellers, Hegeman.

Election of Council President

Mayor Williams called for nominations for the election of Council President. Council member Perkes nominated  Council member Welling.  Council member Sellers nominated Council member Lind. With no further nominations made, and upon call for votes Council member Lind was elected Council President, receiving three votes (Lind, Sellers and Hegeman), Council member Welling receiving two votes (Perkes and Welling) and Council Member Schmidt abstaining.

Ordinance 24-09

Council member Sellers moved, Council member Welling seconded to pass Ordinance 24-09 on third and final reading.

AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 9-3, ADOPTION OF INTERNATIONAL FIRE CODE, OF THE EVANSTON CITY CODE TO PROVIDE FOR ADOPTION OF THE CURRENT INTERNATIONAL FIRE CODE BY RESOLUTION OF THE GOVERNING BODY.

WHEREAS, the City of Evanston has adopted the International Fire Code and other regulatory building codes; and

WHEREAS, the City adopts regulatory building codes by resolution, but adopts the International Fire Code by ordinance; and

WHEREAS, there is a need to amend provisions in the City Code to permit adoption of the International Fire Code by resolution in order to secure the efficient adoption, implementation and enforcement of fire protection and safety measurers;

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT:

Section 1:  Section 9-3 of the Evanston City Code is hereby amended to read as follows:

  • 9-3 Adoption of International Fire Code.
  1. The governing body of the City is hereby authorized to adopt by resolution, for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, the International Fire Code.
  2. From time to time, said International Fire Code may, by resolution duly adopted by the governing body, be amended. Copies of such amendments shall be made available for public inspection in the same manner as the International Fire Code itself.

Section 2:  This ordinance shall become effective immediately on passage on third and final reading.

NOTICE AND ORDER SETTING PUBLIC HEARING

  1. Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given that a public hearing is scheduled regarding Rocky Mountain Power’s (RMP or the Company) request for approval of a five-year commercial and industrial Demand Response Pilot Program and Recovery Mechanism. The public hearing is set to commence on Thursday, February 6, 2025, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Cheyenne, Wyoming.
  2. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility, subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.
  3. On July 8, 2024, RMP filed its Application requesting Commission approval of a five-year commercial and industrial Demand Response Pilot Program and Recovery Mechanism.
  4. Wyoming Industrial Energy Consumers (WIEC) petitioned to intervene in this matter, which the Commission granted by Order issued on August 26, 2024. Office of Consumer Advocate is also a party under the provisions of Wyoming Statute §37-2-402(a).

THE UNDERSIGNED, on behalf of the Robert Brent Bateman Revocable Trust dated September 2, 2009, as amended on July 12, 2018 and September 16, 2019, (the “Trust”) pursuant to Wyo. Stat. § 4-10-507, hereby gives notice of the intent of the trustees to have the property of the settlor distributed as permitted under the terms of the Trust.

Any creditors having a claim against the Trust shall file a claim in writing to the above address within one hundred twenty (120) days from the first date of publication of this Notice. Said claim shall include: (1) the exact outstanding balance of the indebtedness that is claimed as being owed by the settlor or the Trust; (2) an itemization of the outstanding balance; and (3) the name and address of the person to whom communications regarding said claim shall be directed.

YOU ARE FURTHER NOTIFIED that the time allowed for commencmg a proceeding to contest the validity of the Trust or of the proposed distribution of the trustee is one hundred twenty (120) days from the last date of publication of this Notice. If you fail to file a claim or to commence a judicial proceeding to contest the validity of the Trust within the times provided herein, you are forever prohibited from making any claim against the assets of the settlors’ Trust or commencing any judicial proceeding against the settlors or the assets of the settlors’ Trust.

PUBLIC NOTICE

In accordance with the provisions of the Wyoming Environmental Quality Act and Chapter 1 of the Solid Waste Rules, Uinta County has submitted a renewal permit application for the Bridger Valley transfer station.

This facility provides for the transfer of municipal solid wastes and construction and demolition wastes which have been generated within the eastern portion of Uinta County. The 10-acre facility is located approximately 7 miles North of Mtn. View, Wyoming on Highway 414. More specifically, this facility is located in the SE 1/4 of Section 10, T16N, R115W, in Uinta County, Wyoming.  The life of the facility is indefinite as it is a transfer station.

The Department of Environmental Quality (DEQ) has reviewed the application and found it to be complete. Copies of the permit application and the DEQ’s review of the application can be viewed at DEQ’s Cheyenne office at 200 West 17th Street. Any interested person has the right to file comments on the permit application and the DEQ’s completeness review. The period for providing comments shall begin on January 8, 2025, and end on February 22, 2025.  Comments must be received by 5:00 PM on the last day of the notice period. Comments on this application must be submitted in writing to the Department of Environmental Quality, Suzanne Engels, Administrator, Solid and Hazardous Waste Division, 200 W. 17th Street, Cheyenne, Wyoming 82002 or submitted using the DEQ comment portal provided at https://shw.wyomingdeq.commentinput.com/.

DEQ is now conducting a review of the application to determine if it complies with applicable technical standards for a facility of this type. If DEQ finds that the application complies with the technical standards, DEQ will issue a proposed permit and provide public notice and further opportunity to comment on the proposed permit.
