NOTICE OF DEFAULT AND FORECLOSURE SALE

WHEREAS, on January 25, 2013, a certain Mortgage was executed by Roger N. Urness and Mabel O. Urness, Husband and Wife As Joint Tenants and Not As Tenants in Common With Full Rights of Survivorship as mortgagor(s) in favor of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for American Advisors Group., its successors and assigns as mortgagee, and was recorded on February 4, 2013, in Book 991, Page 991 As Reception Number R162041 in the Office of the Clerk and Recorder, Uinta County, Wyoming; and

WHEREAS, the Mortgage was insured by the United States Secretary of Housing and Urban Development (the Secretary) pursuant to the National Housing Act for the purpose of providing single family housing; and

WHEREAS, the Mortgage is now owned by the Secretary, pursuant to an assignment dated September 30, 2019, and recorded on February 3, 2020, in Book 1090 at Page 539,as reception number 1081442 in the office of the Clerk and Recorder, Uinta County, Wyoming; and

WHEREAS, a default has been made in the covenants and conditions of the Mortgage in that the payment due on July 31, 2024, was not made and remains wholly unpaid as of the date of this notice, and no payment has been made sufficient to restore the loan to currency; and

WHEREAS, the entire amount delinquent as of the October 23, 2024 is $155,307.29; and WHEREAS, by virtue of this default, the Secretary has declared the entire amount of the

indebtedness secured by the Mortgage to be immediately due and payable;

NOW THEREFORE, pursuant to powers vested in me by the Single Family Mortgage Foreclosure Act of 1994, 12 U.S.C. 3751 et seq., by 24 CFR part 27, subpart B, and by the Secretary’s designation of me as Foreclosure Commissioner, recorded on September 24, 2024 as Reception Number 116256, notice i s hereby given that on October 23, 2024 at 10:00

a.m. local time, all real and personal property at or used in connection with the following described premises (“Property”) will be sold at public auction to the highest bidder:

The sale will be held at the Unita County Court house, 225 9th St., Evanston, WY 82930. The Secretary of Housing and Urban Development will bid $155,307.29.

There will be no proration of taxes, rents or other income or liabilities, except that the purchaser will pay, at or before closing, his prorata share of any real estate taxes that have been paid by the Secretary to the date of the foreclosure sale.

When making their bids, all bidders except the Secretary must submit a deposit totaling

$15,530.73 in the form of a certified check or cashier’s check made out to the Secretary of HUD. A deposit need not accompany each oral bid. If the successful bid is oral, a deposit of $15,530.73 must be presented before the bidding is closed. The deposit is nonrefundable. The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence. This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check. If the Secretary is the highest bidder, he need not pay the bid amount in cash. The successful bidder will pay all conveying fees, all real estate and other taxes that are due on or after the delivery date of the remainder of the payment and all other costs associated with the transfer of title. At the conclusion of the sale, the deposits of the unsuccessful bidders will be returned to them.

The Secretary may grant an extension of time within which to deliver the remainder of the payment. All extensions will be for 15-day increments for a fee of $500.00, paid in advance. The extension fee shall be in the form of a certified or cashier’s check made payable to the Secretary of HUD. If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due.

If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder may be required to forfeit the cash deposit or, at the election of the foreclosure commissioner after consultation with the HUD representative, will be liable to HUD for any costs incurred as a result of such failure. The Commissioner may, at the direction of the HUD representative, offer the property to the second highest bidder for an amount equal to the highest price offered by that bidder.

There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. HUD does not guarantee that the property will be vacant.

The scheduled foreclosure sale shall be cancelled or adjourned if it is established, by documented written application of the mortgagor to the Foreclosure Commissioner not less than 3 days before the date of sale, or otherwise, that the default or defaults upon which the foreclosure is based did not exist at the time of service of this notice of default and foreclosure sale, or all amounts due under the mortgage agreement are tendered to the Foreclosure Commissioner, in the form of a certified or cashier’s check payable to the Secretary of HUD, before public auction of the property is completed.

The amount that must be paid if the mortgage is to be reinstated prior to the scheduled sale is $155,307.29 as of October 22, 2024, plus all other amounts that would be due under the mortgage agreement if payments under the mortgage had not been accelerated, advertising costs and postage expenses incurred in giving notice, mileage by the most reasonable road distance for posting notices and for the Foreclosure Commissioner’s attendance at the sale, reasonable and customary costs incurred for title and lien record searches, the necessary out-of-pocket costs incurred by the Foreclosure Commissioner for recording documents, a commission for the Foreclosure Commissioner, and all other costs incurred in connection with the foreclosure prior to reinstatement.

Tender of payment by certified or cashier’s check or application for cancellation of the foreclosure sale shall be submitted to the address of the Foreclosure Commissioner provided below.

Second Regular Meeting

September 17th, 2024

The official record of proceedings of the second regular meeting of the Evanston City Council for the month of September was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live.

Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, Dave Welling, Mike Sellers and Jen Hegeman.

The Mayor and Council members spoke regarding appreciation to the Bear Project Board, condolences to the Bateman family, Breast Cancer Awareness month in October, recognition for the hard work on City View and Twin Ridge and appreciation to Veterans.

Public Hearing/Liquor License Renewal

Council member Lind moved, Council member Lynch seconded to remove from the table the public hearing regarding renewal of a Liquor License for JoeCo, LLC dba Queen City Saloon located at 1011 Front Street.

The motion to remove the public hearing regarding the renewal from the table passed unanimously with 7 yes votes:  Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman.

A public hearing was conducted by City Attorney, Mark Harris for the renewal of a liquor license for JoeCo, LLC dba Queen City Saloon located at 1011 Front Street within the City of Evanston.  Mr. Harris asked if there was any opposition or comments regarding the liquor license renewal for Queen City Saloon.  There being no comments, Mr. Harris closed the hearing.

Council member Lynch moved, Council member Lind seconded to approve the renewal of a Liquor License for JoeCo, LLC dba Queen City Saloon located at 1011 Front Street.

The motion to approve the renewal passed unanimously with 6 yes votes:  Williams, Lynch, Lind, Perkes, Welling, Sellers. Council member Hegeman abstained.

Public Hearing/Budget Amendment

A public hearing was conducted by City Attorney, Mark Harris to receive public input concerning amending the City of Evanston 2024-2025 Fiscal Year Budget by increasing general fund expenditures by $84,000 for relocation of a Union Pacific Railroad Water Tower from Wahsatch, Utah to the Evanston Roundhouse and Railyards. Mr. Harris asked if there was any opposition or comments regarding amending the budget.  There being no comments, Mr. Harris closed the hearing.

Street Closure Permit requested by Gara Klements for St. Mary Magdalen Catholic Church’s Blessing of the Animals on Sunday, September 29th, 2024, on Center Street between 8th Street and 9th Street from 1:00 p.m. to 4:00 p.m.

Ordinance 24-07

Council member Welling moved, Council member Lynch seconded, to pass Ordinance 24-07 on third and final reading.

AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING PROVISIONS OF ARTICLE III, REGULATIONS AND RESTRICTIONS, OF CHAPTER 11 OF THE CODE OF THE CITY OF EVANSTON, WYOMING RELATING TO PAWNS AND PAWNSHOPS, PROVIDING FOR ADOPTION OF PROVISIONS OF WYOMING STATUTES REGULATING PAWN FINANCE CHARGES AND MATURITIES.

WHEREAS, in 1982, the City of Evanston adopted Part 3 to Chapter 11 of the Evanston City Code relating to pawnshops and pawn regulation; and

WHEREAS, in 1983, the Wyoming legislature adopted provisions of the Uniform Consumer Credit Code which dealt with regulating pawn finance charges and maturities; and

WHEREAS, the Wyoming legislature preempted regulation of pawn finance charges and maturities by cities and towns, but left cities and towns with the power to determine other pawn and pawnbroker regulation; and

WHEREAS, there is a need to amend Section 11-37 of the City Code to mirror and incorporate state statutes relating to pawn finance charges and maturities;

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT:

Section 1:        Section 11-37 of the Evanston City Code is amended and re-enacted to provide as follows:

  • 11-37 Rates Regulated.
  1. No pawnbroker may contract for, charge or receive an amount as a charge in connection with a pawn transaction other than a pawn finance charge.
  2. The amount financed in any one (1) pawn transaction to any one (1) customer shall not exceed three thousand dollars ($3,000.00).
  3. The maturity date of a pawn transaction shall be one (1) calendar month. The period shall expire on the same date in the succeeding month if there is such a date, otherwise on the last day of the succeeding month. If the expiration date is not a business day, the period expires on the next business day.
  4. Pawn finance charges are fully earned on the day the loan is made.
  5. Pawn transactions may be renewed from month to month without additional disclosures provided:

(1)        There is no change in the original terms; and

(2)        Pawn finance charges are not compounded.

  1. A pawnbroker may contract for and receive a minimum pawn finance charge of not more than five dollars ($5.00).

Bid Award

Councilmember Sellers moved, Councilmember Lynch seconded, to accept the apparent low bid, and issue a notice of award to SCI, Inc. of Lyman, Wyoming for construction of the Grass Valley Force Main Project.  The motion passed unanimously with 7 yes votes:  Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman.

REQUEST FOR PROPOSAL

The Uinta County Library-Evanston is requesting price proposals for the replacement of the floor and wall tiling in seven (7) restrooms. The project consists of the removal of the existing floor and wall tile and replacing it with Castille Chateaux Gris Matte Porcelain and Castille Selah White Ceramic Tile. The contractor will be responsible for measuring and quantifying the square footage for the project. Contractors are welcome to schedule a time to visit the site for measurements if needed outside of the pre-proposal visit.   • Mandatory Pre-proposal Meeting October 8th, 2024, 9:00 a.m. at 701 Main Street, Evanston, WY 82930
  • Proposals Due October 22nd, 2024

DEADLINE FOR SUBMITTALS

The deadline for submittals is 4:00 pm Mountain Standard Time on October 22, 2024.  Any submittal received after the deadline will be returned to the sender unopened.
