First Regular Meeting
October 1st, 2024
The official record of proceedings of the first regular meeting of the Evanston City Council for the month of October was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live.
Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.
The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.
Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, Dave Welling and Mike Sellers. Jen Hegeman was excused.
Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Clerk, Diane Harris; Police Chief, Mike Vranish; City Treasurer, Trudy Lym; Director of Parks and Recreation, Kim Larson; City Engineer, Damon Newsome; Public Works Director, Gordon Robinson; Information Technology Coordinator, Preston Sheets and Community Development Director, Rocco O’Neill. A group of interested citizens was also present.

Council Comments
The Mayor and Council members spoke about extending congratulations to several Evanston High School teams, reminding everyone that October is Breast Cancer Awareness Month and a compensation study for the City.
Public Hearing/Execution of Lease
A public hearing was conducted by City Attorney, Mark Harris to solicit public comment regarding the execution of a Lease With Option to Purchase with AGN, LLC, a Wyoming Limited Liability Company (AGN), and a determination that the sale of real property to AGN pursuant to the Lease Option would benefit the economic development of the Municipality. Community Development Director, Rocco O’Neill presented information. Steve James, Marianne Ayres and Conrad Osborne commented. Mr. Harris closed the hearing.
Public Hearing/Microbrewery Permit
Council member Sellers moved, Council member Welling seconded to table the Public Hearing and Motion to approve a Microbrewery Permit for Shades of Pale, Inc., dba: Shades Brewing located at 1512 Main Street to October 15th, 2024.

Uinta Wind Project
Council member Lynch moved, Council member Welling seconded to approve Uinta Wind’s request to the Industrial Siting Commission for an extension of time to commence construction of the Uinta Wind Project.

Wyoming Horse Racing Update
Peter Liguori of Wyoming Horse Racing presented an update on the progress of the new facility being built on Prospector Drive and requested a letter of support for a plan amendment.
Department Comments
City Attorney Mark Harris notified the Council and public that an agreement had been reached regarding impact assistance funds for the Dry Fork Soda Project and the Council would see a resolution on the matter at the next meeting.
Public Works Director Gordon Robinson commented on the tragedy of one of the employees in his department. He sent condolences to the family.

Rebecca Osterberg, Human Services Coordinator gave an update on the FY25 Community Services Block Grant (CSBG) informing the Commissioners of a 1% increase in funding which would increase the funds allocated to Uinta County from $118,210 to $119,392.

Motion South, second Hatch to approve the CSBG Grant Agreement for $116,356, which was modified to correct a misprint, through November 15, 2025 to provide support services to low-income individuals, families, and agencies as presented by Osterberg. 3 yes votes, passed.

Motion Hatch, second South to approve a Micro-Grant Agreement with the Department of Justice for $15,038 with a 50% county match for the purchase of 20 Body Worn Cameras for Sheriff’s Deputies from 1/1/2024 – 12/31/2026 as requested by Josh Rasnake, Emergency Management. 3 yes votes, passed.
Industrial Siting DEQ Permit (MOU)

The sale will be held at the Unita County Court house, 225 9th St., Evanston, WY 82930. The Secretary of Housing and Urban Development will bid $155,307.29.
There will be no proration of taxes, rents or other income or liabilities, except that the purchaser will pay, at or before closing, his prorata share of any real estate taxes that have been paid by the Secretary to the date of the foreclosure sale.
When making their bids, all bidders except the Secretary must submit a deposit totaling
$15,530.73 in the form of a certified check or cashier’s check made out to the Secretary of HUD. A deposit need not accompany each oral bid. If the successful bid is oral, a deposit of $15,530.73 must be presented before the bidding is closed. The deposit is nonrefundable. The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence. This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check. If the Secretary is the highest bidder, he need not pay the bid amount in cash. The successful bidder will pay all conveying fees, all real estate and other taxes that are due on or after the delivery date of the remainder of the payment and all other costs associated with the transfer of title. The Secretary may grant an extension of time within which to deliver the remainder of the payment. All extensions will be for 15-day increments for a fee of $500.00, paid in advance. The extension fee shall be in the form of a certified or cashier’s check made payable to the Secretary of HUD. If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due.
If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder may be required to forfeit the cash deposit or, at the election of the foreclosure commissioner after consultation with the HUD representative, will be liable to HUD for any costs incurred as a result of such failure. The Commissioner may, at the direction of the HUD representative, offer the property to the second highest bidder for an amount equal to the highest price offered by that bidder.
There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. HUD does not guarantee that the property will be vacant.
The scheduled foreclosure sale shall be cancelled or adjourned if it is established, by documented written application of the mortgagor to the Foreclosure Commissioner not less than 3 days before the date of sale, or otherwise, that the default or defaults upon which the foreclosure is based did not exist at the time of service of this notice of default and foreclosure sale, or all amounts due under the mortgage agreement are tendered to the Foreclosure Commissioner, in the form of a certified or cashier’s check payable to the Secretary of HUD, before public auction of the property is completed.
