Final payment will be made after the completion of publication of this Notice. The date of first publication is November 22nd, 2023, and the date of final settlement will be after January 2nd, 2024, and when all punch list items are complete.

NOTICE SETTING PUBLIC HEARING

  1. Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given that a public hearing is scheduled regarding Rocky Mountain Power’s (RMP or the Company) request for authority to increase rates to recover deferred Net Power Costs (NPC) under Tariff Schedule 95; and to decrease rates pursuant to Tariff Schedule 93, Renewable Energy Credits (RECs) and Sulfur Dioxide (SO2) emission allowances. The public hearing is set to commence on Tuesday, December 19, 2023, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Cheyenne, Wyoming.
  2. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility, subject to the Commission's jurisdiction. WYO. STAT. §§ 37-l-101(a)(vi)(C) and 37-2-112.
  3. On April 17, 2023, RMP filed an Application requesting authority to revise rates pursuant to two different rate schedules. The Company proposes to increase its Tariff Schedule 95 Energy Cost Adjustment Mechanism (ECAM) rates by approximately $50.3 million to recover deferred NPC. The Company also proposes to decrease its Tariff Schedule 93 REC and SO2 Revenue Adjustment Mechanism (RRA) rates by approximately $1.5 million to account for sales of RECs and SO2 emission allowances.
  4. Wyoming Industrial Energy Consumers (WIEC) and the Public Service Consumer Advocate Staff petitioned to intervene in this matter, which the Commission granted by Orders issued on May 9th and 22nd, 2023, respectively. On June 29, 2023, the Commission granted interim approval of the proposed rates effective for usage on and after July 1, 2022, subject to further review, refund and hearing.
  5. The Commission held Public Comment hearings in Rock Springs, Casper, Riverton, Laramie and Casper on July 17, August 24, September 18, September 25 and October 12, 2023, respectively.

Public Notice

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for authority to revise Rule 3 to provide for updated provisions regarding liability for damages, as more fully described below:

1, RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers in its service territory consisting of parts of six states, including Wyoming. RMP is a public utility, subject to the Commission's jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.

2, On October 24, 2023, the Company filed an Application requesting authority to revise Electric Service Rule 3 to update provisions regarding liability for atypical damages.

3, Specifically, RMP seeks authority to limit damages to actual damages arising from providing electric services and to exclude atypical damages such as special, noneconomic, punitive, incidental, indirect, or consequential damages. RMP’s Application states that to ensure reasonable rates and services, and financial backing to support operations, limitation of liability provisions is necessary.

4, This is not a complete description of RMP’s Application. First Regular Meeting

November 7th, 2023

The official record of proceedings of the first regular meeting of the Evanston City Council for the month of November was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live.

Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, Mike Sellers and Jen Hegeman.  David Welling was excused.

Council Comments

Council member Lind reminded everyone to be careful since the snow is coming.  Council member Sellers commented that with the changing weather and shorter days people can become discouraged and to remember that the U.S. National Suicide Prevention Lifeline is 988 or text “WYO” to 741-741 for the Crisis Text Line.  With Veteran’s Day around the corner, Council member Hegeman thanked all the Veterans and their families for their service.

Public Hearing/Conditional Use Permit

City Attorney, Mark Harris began the Public Hearing by explaining the legalities of the hearing, and how it would be conducted.  Applicants would be heard from first, followed by those who have questions for the applicant, and finally those opposed to the application. He asked each person speaking to clearly state their name and home address for the record prior to being sworn to testify.

Attorney Harris opened the hearing for CP 185, a request by Todd Osterling for a Conditional Use Permit to allow a detached accessory building to exceed 60 Percent of the square foot size of the principal building’s footprint and to allow the total of all detached accessory buildings to exceed 75 percent of the square foot size of the principal building’s footprint for property located at 1600 West Center Street, Evanston, Wyoming, which is zoned Low Density Residential-Established (LR-E).

Todd Osterling was sworn in and spoke on behalf of the application.

Erin Osterling was sworn in and spoke on behalf of the application.

Kathy Cook was sworn in and spoke on behalf of the application.

NOTICE

MountainWest Overthrust Pipeline, LLC Westbound Compression Project

MountainWest Overthrust Pipeline, LLC filed an application on November 2, 2023 in Docket No. CP24-13-000 with the Federal Regulatory Energy Commission (FERC) pursuant to Section 7(c) of the Natural Gas Act for a certificate of public convenience and necessity authorizing MountainWest Overthrust Pipeline to construct, install, modify, operate and maintain its Westbound Compression Project.  The Project will enable MountainWest Overthrust Pipeline to add a total of approximately 325M dekatherms per day (Dth/d) of pipeline capacity to the MountainWest system by the fourth quarter of 2025.

The Project will consist of the following components:

Rock Springs: Installing additional compression horsepower.

Point of Rocks: Installing additional compression horsepower.

Kern River Gas Transmission Interconnect: New interconnect near existing facilities; Kern River Gas Transmission will design and build new facilities.

Ancillary Scope: Various upgrades to existing facilities and expansion of the Wamsutter meter station to accommodate additional gas volume.

MountainWest Overthrust Pipeline owns and operates an interstate natural gas pipeline system and is regulated by FERC. The company must obtain FERC approval to construct the proposed facilities.  A separate notice regarding the application will be mailed to affected landowners and other stakeholders involved with the project. Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Special Regulations, notice is hereby given of the joint Application of Questar Gas Company dba Dominion Energy Wyoming (DEW or the Company) and Enbridge Quail Holding, LLC (Enbridge) for approval of the reorganization and sale of Fall West Holdco, LLC (Fall West) to Enbridge Quail Holdings, LLC.

  1. DEW is currently a wholly owned subsidiary of Dominion Energy Questar Corporation, which itself is a wholly owned subsidiary of the parent company, Dominion Energy, Inc. The parent company, Dominion Energy Inc., is a Virginia corporation engaged in the business of supplying energy services in 16 states, including natural gas services in Utah, Wyoming, and Idaho. DEW serves approximately 28,000 customers in southwestern Wyoming, including customers in Rock Springs, Green River, Kemmerer, Diamondville, and Evanston. DEW is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(C) and 37-2-112.
  2. On September 5, 2023, DEW’s parent company, Dominion Energy, Inc., announced its intention to sell DEW, Wexpro Company, and other related entities to Enbridge, Inc. On September 8, DEW filed a joint Application for the partial reorganization and transfer of ownership of DEW to Fall West under Docket Nos. 30010-217-GA-23 and 30027-1-GA-23. On October 20, 2023, DEW filed a joint Application with Enbridge for approval of the sale and corporate reorganization of Fall West to Enbridge. DEW will remain under the regulatory jurisdiction of the Commission.
  3. The Company states that the reorganization will not adversely affect DEW’s operations and ability to provide the public with safe and reliable utility service. Per the Application, no costs associated with reorganization will be allocated to Wyoming customers and the reorganization will not impact Wyoming customers’ rates.

RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers in its service territory consisting of parts of six states, including Wyoming. RMP is a public utility, subject to the Commission's jurisdiction. WYO. STAT. §§ 37-l-101(a)(vi)(C) and 37-2-112.
  2. On November 3, 2023, the Company filed Service Quality Review Reports for calendar years 2021 and 2022. RMP states the reports provide an overview of key reliability metrics delivered during 2021 and 2022, and that the reports identify performance associated with the Company’s Service Standards Program including the electric reliability and power quality metrics and reporting.
  3. The reports are required to be filed with the Commission for approval for RMP to establish baseline standards for electric reliability pursuant to Commission Rule, Chapter 3, Section 38(e) and Wyoming Statute §§ 37-18-101 and 102 (HB200, 2020).
