NOTICE OF INTENT TO SELL PROPERTY

The City of Evanston intends to sell to the high bidder at a public auction the real and personal  property located at 56, 60,70 and 66 Rail Center, Evanston, Wyoming, more particularly described as:

Real Property:

Lots 4, 5, 6, & 7 of Block 1 of the Evanston Rail Center Second Addition to the City of Evanston, Uinta County, Wyoming;

TOGETHER WITH all buildings and improvements thereon and appurtenances thereto and all rights, privileges and hereditaments belonging or appertaining thereto; and

SUBJECT to easements, rights-of-way, reservations, covenants and restrictions of record.

Personal Property:

The sale will include all of the equipment currently located on the property which may include

a Certified Cardinal Pitless Scale with loading ramp, a 250 HP Sellers Boiler and all underground infrastructure, a Williams Scotsman Modular 10 x 36 wRR (1995), a Portable Crude Oil Metering Cart, asphalt reclaimer, steam, condensate and product piping for nine rail tank cars on either track;

There are two (2) railroad tracks located on the real property, Track 825 and Track 826.

Track 825 is owned by Union Pacific Railroad and is not owned by the City and will not be sold as part of this sale.  The City  has leased Track 825 from the railroad but the lease cannot be assigned to or assumed by the high bidder. The successful bidder for the  property will have to obtain a lease from Union Pacific Railroad in order to use Track 825.

Track 826 is owned  by the City and all right title and interest in Track 826, shall be transferred and conveyed by the City to the high bidder as part of this sale.  Track 826 is subject to a Railroad Industry Track Agreement.  The City will not assign the existing Railroad Industry Track Agreement to the high bidder and the high bidder will need to obtain its own Railroad Industry Track Agreement from Union Pacific Railroad in order to use Track 826.

All persons desiring to purchase said  property should attend a public auction to be conducted by the Community Development Director or his designee at 1200 Main St. Evanston, Wyoming on June 6, 2019 at 11:00 a.m.

The terms of the sale shall be as follows:

  1. The real and personal property shall be sold together as a package to the high bidder. The real property shall not be sold separately from the personal property or vice versa.
  2. The conveyance of the property to the high bidder by the City shall be by quitclaim deed and bill of sale, subject to all easements, rights-of-ways, reservations, restrictions and existing or future oil and gas and/or other mineral leases, now of record. The City will not provide title insurance or any type of title commitment to the successful bidder.

3  The property will be sold in its entirety “as is where is” and the successful bidder will accept the property without any express or implied warranties, and will assume the risk for any claims, costs, liabilities, expenses or demands of whatsoever nature or source for any defects or environmental problems in the property, latent or obvious, discovered or undiscovered.

  1. The property is located in an Industrial Established zoning district and questions about what uses of the property may be permitted in an Industrial Established  zone should be directed to the City Planning Department.  It shall be the responsibility of the bidder to make sure that its anticipated use of the property is  permitted or conditionally permitted within the zoning district.
  2. The high bidder shall tender a certified check or money order made payable to the City of Evanston in the amount of the bid price within twenty four hours of the time of sale. The minimum bid amount for which the City will consider selling the property is $250,000.00.
  3. The high bid will be considered by the governing body of the City of Evanston at its next regular or special meeting after the auction and will approve the sale to the highest bidder or reject all bids.

7..  By submitting a bid, each bidder is agreeing to and accepting all of the terms, conditions and limitations of the sale as set forth in this Notice of Intent to Sell Property.

FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest has occurred under the terms of a Promissory Note (the “Note”) dated April 1, 2015, executed and delivered by Tracy F. Warburton (“Mortgagor”) to AMCAP Mortgage LTD. DBA Major Mortgage Co., and a real estate Mortgage (the “Mortgage”) of the same date securing the Note, which Mortgage was executed and delivered by said Mortgagor, to Mortgage Electronic Registration Systems, Inc. as nominee for AMCAP Mortgage LTD. DBA Major Mortgage Co., its successors and assigns as Mortgagee, and which Mortgage was recorded on April 6, 2015, at Reception No. R169217, in Book 1022, at Page 843 in the public records in the office of the County Clerk and ex-officio Register of Deeds in and for Uinta County, State of Wyoming; and

WHEREAS, the Mortgage was assigned for value as follows:

Assignment recording information: at Reception No. 1067574, in Book 1078, at Page 757-758

All in the records of the County Clerk and ex-officio Register of Deeds in and for Uinta County, Wyoming.

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage as of June 1, 2019 being the total sum of $105,138.70, plus interest, costs expended, late charges, and attorneys’ fees accruing thereafter through the date of sale;

WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid;

WHEREAS, if the foreclosure sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of his/her/its money paid.  The Purchaser shall have no further recourse against the Mortgagee, Mortgagor, Servicer or their attorneys;

NOW, THEREFORE American Financial Resources, Inc., a New Jersey Corporation, as the Mortgagee, will have the Mortgage foreclosed as by law provided by causing the mortgaged property to be sold at public venue by the Sheriff or Deputy Sheriff in and for Uinta County, Wyoming to the highest bidder for cash at 10:00 o’clock in the forenoon on June 5, 2019 at the information desk at the Uinta County Courthouse located at 225 9th Street, Evanston, WY 82930, for application on the above described amounts secured by the Mortgage, said mortgaged property being described as follows, to-wit:

Lot 7 in Block 3 of the Rees Subdivision, being located in Uinta County, Wyoming, according to the Plat recorded January 11 ,1979, as instrument No. 325637, in the office of the Uinta County Clerk . 

With an address of 443 Rees Road, Lyman, WY 82937 (the undersigned disclaims liability for any error in the address).

Together with all improvements thereon situate and all fixtures and appurtenances thereto.

Mortgagee shall have the exclusive right to rescind the foreclosure sale during the redemption period.  In the event that the sale is rescinded or vacated for any reason, the successful purchaser shall only be entitled to a refund of their purchase price and/or statutory interest rate.
