NOTICE OF INTENT TO SUBDIVIDE

Kandy Estella Roberts intends to file an application for a two lot subdivision of part of the S ½ SW ¼ of Section 24, T16N, R115W, 6TH P.M., Uinta County, Wyoming. The Subdivision is located approximately 1.7 miles North of the Town of Lyman, Wyoming. The final plat will be presented at the Uinta County Commissioners Meeting at approximately 2:00 p.m. May 17th, 2022 at the Commission Meeting Room in the County Courthouse at 225 Ninth Street in Evanston, Wyoming.

FORECLOSURE SALE NOTICE

WHEREAS NOTICE IS HEREBY GIVEN that a default in the payment under the terms of a secured and perfected Note has occurred.  The Note is secured by a Mortgage dated November 23, 2016 and recorded on November 23, 2016 at REC # 1028229 Book 1046, Page 967 in the records of Uinta County, Wyoming from Samantha R. Howard, to Mortgage Electronic Registration Systems, Inc., as nominee for Buffalo Federal Bank for the amount of $147,979.00.  The Mortgage having been assigned to and now in possession of PennyMac Loan Services, LLC, through an assignment recorded on February 25, 2022 at REC# 1119437 in Book 2035, Page 191 in the records of Uinta County, Wyoming.

WHEREAS the Mortgage contains a power of sale, which by reason of the default that has occurred, the Mortgagee has declared to become operative, and no suit or proceeding has been instituted to recover the debt secured by the Mortgage, or any part thereof, nor has any suit or proceeding instituted and the same discontinued and:

WHEREAS written Notice of Intent to Foreclose by Sale and Advertisement has been served upon the record owner and party in possession of the mortgaged premises at least ten (10) days prior to commencement of the publication, and the amount due upon the Mortgage at the date of first publication of this notice of sale being the estimated total sum of $149,876.12 which consists of the unpaid principal balance of $137,310.07, outstanding charges, attorney fees, costs expected, accruing interest and late charges after the date of first publication of this notice.

WHEREAS this property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale and any prospective purchaser should research the status of title before submitting a bid.

WHEREAS, default in the payment of principal and interest has occurred under the terms of a Promissory Note (the “Note”) dated November 1, 2016, executed and delivered by Sonja D. Barton (“Mortgagor”) to Catalyst Lending, Inc., and a real estate Mortgage (the “Mortgage”) of the same date securing the Note, which Mortgage was executed and delivered by said Mortgagor, to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Catalyst Lending, Inc., its successors and assigns as Mortgagee, and which Mortgage was recorded on November 1, 2016, at Reception No. 1027296, in Book 1045, at Page 1045-1058 in the public records in the office of the County Clerk and ex-officio Register of Deeds in and for Uinta County, State of Wyoming; and

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage as of April 20, 2022 being the total sum of $106,250.01, plus interest, costs expended, late charges, and attorneys’ fees accruing thereafter through the date of sale;

The West 90 feet of the North 60 feet of Lot 1 and the West 90 feet of the South 90 feet of Lot 2 in Block 11 of W.H. Together with all improvements thereon situate and all fixtures and appurtenances thereto.

Mortgagee shall have the exclusive right to rescind the foreclosure sale during the redemption period.  In the event that the sale is rescinded or vacated for any reason, the successful purchaser shall only be entitled to a refund of their purchase price and/or statutory interest rate.
