The project consists of all labor, material, equipment, and incidentals necessary to complete demolition of; concrete curb, gutter, sidewalk, asphalt, retaining wall (complete), chain link fence, and other misc. items. New construction includes 2,016 SY asphalt pavement, 933 SY sidewalk, misc. concrete, 135 LF curb & gutter, 45 LF chain link fence, 2 catch basins, ±150 LF 6” Drainpipe, 2 gravel drain sumps, drainage channel with rock rip rap, other misc. work, and material testing. A Bid Alternate of ±2,500 SY of asphalt pathing at various District facilities is included.

First Regular Meeting

May 4th, 2021

The official record of proceedings of the first regular meeting of the Evanston City Council for the month of May was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. The meeting was also streamed live.

Council member Perkes led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Tib Ottley, Evan Perkes, David Welling, and Mikal Welling. Council member Mike Sellers was excused.

Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Community Relations/Grant Writer, Meike Madrid; Director of Engineering and Planning, Dean Barker; Public Works Director, Gordon Robinson; Senior Planner, DuWayne Jacobsen and Police Lieutenant Ken Pearson. Community Development Director, Rocco O’Neill; Police Chief Jon Kirby and Director of Parks and Recreation, Scott Ehlers were excused. A group of interested citizens were also present.

Council Comments

In honor of Municipal Clerk’s Week, Mayor Williams expressed appreciation to City Clerk, Diane Harris for her hard work and dedication.

Public Hearing/Annual Budget 2020-2021

City Attorney, Dennis Boal conducted a public hearing to receive public information, input, comments, and concerns for a proposed modification to the budget for Fiscal year 2020 and the City of Evanston Fiscal Year 2020-2021 Annual Budget. City Treasurer, Trudy Lym, gave an overview and brief summary of the modifications and the upcoming budget. No one else addressed the issue and Mr. Boal closed the hearing.

AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SUBSECTION A. AND ENACTING SUBSECTION F. OF SECTION 4-9 OF CHAPTER 4, ALCOHOLIC BEVERAGES, TO REDUCE THE PUBLICATION AND POSTING REQUIREMENTS FOR A NOTICE OF A LIQUOR LICENSE APPLICATION AND SPECIFYING THE APPEAL PROCEDURE FOR A DENIED RENEWAL LICENSE.

WHEREAS, the Wyoming Legislature has amended the state statute to reduce the publication and posting requirements of a Notice of a liquor license application and specifying the appeal procedure for a renewal license which has been denied by the City; and

WHEREAS, the City of Evanston desires to amend its Alcoholic Beverage Ordinance in response to the amendments in state law;

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT:

Section 1. Section 4-9 A. and F. of the Evanston City Code are hereby amended and enacted to provide as follows:

  • 4-9. Notice of application; hearing; grounds for denial; renewal applications to be granted preference; appeals.
  1. When an application for a license, permit, renewal or any transfer of location or ownership thereof has been filed with the City council pursuant to this Part 2, the City clerk shall promptly prepare a notice of application and place the notice conspicuously upon the premises shown by the application as the proposed place of sale and publish the notice in the newspaper of local circulation once a week for four two consecutive weeks. The notice shall state that a named applicant has applied for a license, permit, renewal or transfer thereof and that protests against the issuance, renewal or transfer of the license or permit will be heard at a designated meeting of the City council. Each applicant shall, at the time of filing his application, pay the City clerk the amount sufficient to cover the costs of publishing such notice.
  2. Upon an appeal the person applying for renewal of a license shall be named as plaintiff, with the City named as defendant. During the pendency of an appeal, a renewal license denied by the City shall not be granted to any other applicant. Upon notice of appeal the clerk shall transmit to the clerk of the district court a certified copy of the application, of each protest if any, and of the minutes recording the decision appealed from. The appeal shall be heard as a trial de novo with evidence taken and other proceedings had as in the trial of civil actions. The court may accept and consider as part of the record certified documents forwarded to the court by the clerk of the City.

Section 2. This ordinance shall be effective on July 1, 2021.

WHEREAS, the Wyoming Legislature has amended the state statute to enable certain liquor licensees to deliver alcohol liquors and malt beverages to customers; and

WHEREAS, the City of Evanston desires to amend its Alcoholic Beverage Ordinance in response to the amendments in state law;

Section 1. Section 4-12.2 of the Evanston City Code is hereby enacted to provide as follows:

  • 4-12.2 Delivery of alcoholic liquors and malt beverages.
  1. Retail liquor licensees, microbrewery permit holders, winery permit holders, winery satellite permit holders and manufacturer licensees with a satellite location may deliver or contract to have delivered alcoholic liquors and malt beverages to customers provided

(1) All sales of alcoholic liquors and malt beverages under this section shall take place in the licensed building. Orders of alcoholic liquors and malt beverages may be placed by phone, online or through a mobile application. All deliveries under this section shall be completed during the licensee’s remaining operating hours on the same day the alcoholic liquors or malt beverages are removed from the inventory of the licensed premise;

(2) No order shall be received nor shall any delivery be made to or by a person under the age of twenty-one (21) years. All deliveries shall require the purchaser to provide to the deliverer a valid government issued          identification demonstrating the purchaser is twenty-one (21) years of age or older;

(3) All package sales and deliveries of alcoholic liquors and malt beverages for off-premises consumption shall be sealed. For purposes of this paragraph, “sealed” means a product enclosed:

  1. a) In its original package and unopened;
  2. b) In a plastic bag and heat sealed closed; or
  3. c) In a container that has a breakable seal incorporated in the container cap.

(4) Any contract delivery service shall adhere to the requirements of this section when delivering alcoholic liquors and malt beverages; and

(5) Microbrewery permit holders, winery permit holders, winery satellite permit holders and manufacturer licensees with a satellite location shall only deliver or contract to have delivered their respective manufactured products.

Section 2. This ordinance shall be effective on July 1, 2021.
