EVANSTON CITY COUNCIL

Second Regular Meeting

October 18th, 2022

The official record of proceedings of the second regular meeting of the Evanston City Council for the month of October was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live.

Council member Sellers led those in attendance in the Pledge of Allegiance to the Flag.

The roll was called and with a quorum being present, Council member Perkes called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were:  Council members Tim Lynch, Mike Sellers and Evan Perkes.  Tib Ottley, Dave Welling, Mikal Welling and Mayor Williams appeared by video.

Staff members present at the start of the meeting were:  Community Development Director, Rocco O’Neill; Police Chief, Mike Vranish; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Information Technology Coordinator, Preston Sheets; City Engineer, Dean Barker; Director of Parks and Recreation, Scott Ehlers; Senior Planner, DuWayne Jacobsen; Public Works Director, Gordon Robinson and City Attorney, Dennis Boal.

ORDINANCE 22-04

AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 24-105 OF CHAPTER 24, ZONING, OF THE CITY CODE TO ALLOW MORE THAN ONE KITCHEN IN A DWELLING UNIT.

WHEREAS, the definition of “Dwelling Unit” in Section 24-105 currently provides that there may be only one kitchen in a dwelling unit used for single family occupancy; and

WHEREAS, there has been a demonstrated need to amend the ordinance to allow more than one kitchen in a dwelling unit and at same time, not increase the density of residential neighborhoods; and

WHEREAS, the Planning and Zoning Commission held a public hearing on September 13, 2022, to receive comments, information and input from the public regarding the proposed amendments to the definitions of “Dwelling Unit” and “Kitchen” in Section 24-105 of the code which would allow for more than one kitchen in a dwelling unit, and yet, not increase the density of the neighborhood; and

WHEREAS, notice of the public hearing was published in a local newspaper of general circulation at least fifteen days in advance of the hearings; and

WHEREAS, as a result of the hearing, the Planning and Zoning Commission forwarded a positive recommendation to the Governing Body of the City of Evanston to amend the definitions of “Dwelling Unit” and “Kitchen” as set forth below;

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT:

Section 1: The Definitions of “Dwelling Unit” and “Kitchen” set forth in Section 24-105 of Chapter 24 of the Evanston City Code are hereby amended and re-enacted to provide as follows:

  • 24-105. Definitions and standards enumerated.

DWELLING UNIT - One or more rooms in a dwelling or portion thereof, used and designed and intended to be used for occupancy by one family or a group living together as a single unit as described in Section 24-17 of the Evanston City Code, including permanent provisions for living, eating, sleeping and sanitation, containing one or more kitchens.

KITCHEN -That portion of a dwelling unit devoted to the cooking or preparation of food for the purpose of consumption by residents of the dwelling unit.  The presence within any food preparation area of a ventilation hood, gas stub, 220-volt electrical outlet or wiring, or any combination thereof together with a refrigerator and a sink, shall be considered a kitchen.  The term shall include a kitchenette, wet bar or similar area equipped with a means to cook or prepare food.

A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF A GRANT AWARD AGREEMENT WITH THE WYOMING OFFICE OF HOMELAND SECURITY TO OBTAIN FUNDS WHICH ARE DESIGNATED FOR LAW ENFORCEMENT TERRORISM PREVENTION-ORIENTED ACTIVITIES AND EQUIPMENT.

Department Comments

Community Development Director Rocco O’Neill commented that it is great to see Council member Ottley.  He also reminded everyone that there are several fundraising activities going on for Kendell Cummings, the young man from Evanston who was critically injured from a grizzly bear attack.

Evanston High School Domestic Water Line Replacement

Notice is hereby given that the UINTA COUNTY SCHOOL DISTRICT NO. 1 has accepted as completed according to the plans, specifications, and rules governing the same work performed under that certain Contract between the School District No. 1 and Industrial Piping and Welding, 5282 South Commerce Drive #D272, Murray UT 84107, the Contractor on the UCSD1 Evanston HS Domestic Water Replacement. The Contractor is entitled to final settlement for work under this Contract and the School District will make final payment to the Contractor herein mentioned for the full amount due on the forty-first day after first publication of this notice, being first published on Friday, October 21, 2022, and final payment to be made on Thursday, December 1, 2022.
