PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules, notice is hereby given of Rocky Mountain Power’s (RMP or the Company) application requesting an accounting order to defer costs related to repowering wind plants or for alternate relief (Application).

RMP is a public utility as defined in Wyo. Stat. § 37-1-101(a)(vi)(C), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112. 

On December 30, 2019, RMP filed an Application requesting authority to [i] defer for future recovery, the costs associated with the repowering of its Glenrock I, Glenrock III, Rolling Hills, Seven Mile I, Seven Mile II, High Plains, McFadden Ridge, Dunlap, Marengo I, Marengo II and Goodnoe Hills wind facilities (Repowering Project); [ii] defer for future recovery, the costs and benefits associated with the repowering of its Leaning Juniper wind plant; and [iii] alternatively, if the Commission determines that the Repowering Project’s or Leaning Juniper’s costs and the Production Tax Credit (PTC) benefits are not appropriate for deferred accounting, the Company requests an order allowing it to remove the benefits of the Repowering Project and Leaning Juniper from the Energy Cost Adjustment Mechanism (ECAM) until the rate effective date of the Company’s next general rate case.

RMP states it is nearing completion of its Repowering Project and Leaning Juniper and its requested deferral will allow the Company to recover its prudently incurred costs from 2019 and those it will incur in 2020. RMP seeks to record and defer for later recovery, [a] the return on investment; [b] depreciation expense; [c] operation and maintenance costs; [d] property taxes; [e] wind taxes, if assessed; [f] incremental net power costs; and [g] PTC benefits, associated with its Repowering Project and Leaning Juniper, on a monthly basis, beginning when the facilities are placed into service, until rates from the Company’s next general rate case become effective.

RMP states it is seeking to appropriately match the realization by its customers of the benefits from the Repowering Project and Leaning Juniper, through the ECAM. The Company also notes its Repowering Project, and the associated costs, received Commission approval and were found to be in the public interest. Additionally, RMP states the Repowering Project and Leaning Juniper will be subject to a public process in which parties will have an opportunity to review these wind projects and any associated costs.

This is not a complete description of the Application. Interested persons may inspect the Application at the Commission’s offices in Cheyenne, Wyoming during regular business hours. The Application may also be viewed on the Commission’s data management system at https://dms.wyo.gov/external/publicusers.aspx.

Anyone desiring to file a public comment, statement, intervention petition, protest or request for a public hearing in this matter must do file with the Commission in writing on or before February 14, 2020. Any intervention request filed with the Commission shall set forth the grounds of the proposed intervention or request for hearing as well as the position and the interest of the petitioner in this proceeding.

First Regular Meeting

January 7, 2020

The official record of proceedings of the first regular meeting of the Evanston City Council for the month of January was held in the Council Chambers of City Hall on the above date.  These proceedings were video recorded.

Mayor Kent Williams led those in attendance in the pledge of allegiance to the Flag.

The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present.

Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers, and Mikal Welling.

Staff members present at the start of the meeting were:  City Clerk, Nancy Stevenson; City Treasurer, Trudy Lym; Community Development Director, Rocco O’Neill; Police Chief, Jon Kirby; Director of Engineering & Planning, Dean Barker; Public Works Director, Gordon Robinson; and Director of Parks and Recreation, Scott Ehlers.    City Attorney, Dennis Boal was excused.  A group of interested citizens were also present.

Resolution 20-01

Councilmember Perkes introduced Resolution 20-01.  Councilmember Perkes moved, Councilmember Sellers seconded, to adopt Resolution 20-01.

RESOLUTION 20-02:  RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A BUILDING USE AGREEMENT WITH THE EVANSTON YOUTH CLUB FOR BOYS AND GIRLS, A WYOMING NON PROFIT CORPORATION, TO PROVIDE A YOUTH AFTER SCHOOL PROGRAM IN A CITY BUILDING.

Comments/Remarks

The Department Heads each thanked the Mayor and Councilmembers for their appointments and support.

Scott Ehlers announced that the Parks and Recreations Department will be hosting the Senior Olympics in 2021.

Public Participation

Tammy Halliday thanked everyone for supporting the New Year’s Eve Gala.

Kayne Pyatt announced that Sage Brush Theater will be hosting an “Evening with Shakespeare” at the Strand on January 17th & 18th at 7:00 p.m. each evening and encouraged to attend.

NOTICE OF INTENT TO SELL PROPERTY

The City of Evanston intends to sell to the high bidder at a public auction the real property located in the City of Evanston, Wyoming, as described below:

Real Property to be Sold:

Lot 2 of Block 1 of the Haw Patch 3rd Addition to the City of Evanston, Uinta County, Wyoming;

SUBJECT to easements, rights-of-way, reservations, covenants and restrictions of record.

Public Auction:

All persons desiring to purchase said property should attend a public auction to be conducted on January 28, 2020, by the Community Development Director or his designee at 1200 Main St. Evanston, Wyoming at 11:00 a.m.

Terms of Sale:

The terms of the sale shall be as follows:

  1. The conveyance of the property to the high bidder by the City shall be by quitclaim deed subject to all easements, rights-of-ways, reservations, restrictions and existing or future oil and gas and/or other mineral leases, now of record. The City will not provide title insurance or any type of title commitment to the successful bidder.
  2. The property will be sold in its entirety “as is where is” and the successful bidder will accept the property without any express or implied warranties, and will assume the risk for any claims, costs, liabilities, expenses or demands of whatsoever nature or source for any defects or environmental problems in the property, latent or obvious, discovered or undiscovered.
  3. The property is located in a Medium Density Residential-Developing zoning district and questions about what uses of the property may be permitted in the zone should be directed to the City Planning Department. It shall be the responsibility of the bidder to make sure that its anticipated use of the property is permitted or conditionally permitted within the zoning district.
  4. The high bidder shall tender a certified check or money order made payable to the City of Evanston in the amount of the bid price within twenty four hours of the time of sale. The minimum bid amount for which the City will consider selling the property is $75,000.00.
  5. The high bid will be considered by the governing body of the City of Evanston at its next regular or special meeting after the auction and will approve the sale to the highest bidder or reject all bids.
  6. By submitting a bid, each bidder is agreeing to and accepting all of the terms, conditions and limitations of the sale as set forth in this Notice of Intent to Sell Property.
  7. Bidders are encouraged to physically view and inspect the property prior to bidding. Questions about the property should be directed to the City’s Planning Department.
