Woman appears for alleged shovel assault

EVANSTON — On Feb. 22, Christy Barney of Evanston appeared in Uinta County Circuit Court for a preliminary hearing. Barney is accused of aggravated assault with a deadly weapon, a felony.

Evanston police officer Justin George was called to the stand by prosecuting attorney Dean Stout; he was the only witness called during the proceedings.

George testified he was called to a residence in South Park Village on Jan. 30 to respond to a 911 call. The caller indicated a woman was bleeding badly and required medical attention.

George testified Jessica Skaggs was found awake and alert, though crying, with blood coming from wounds on her head. Skaggs was bleeding on her clothing and on the ground.

George went on to say the victim was transported by ambulance to Evanston Regional Hospital for treatment. Pictures of the victim’s wounds were submitted as evidence, as were photographs of a shovel or spade suspected of being used in the attack.

George described the scene as one where various items were scattered around on the front porch and stairs of Barney’s residence as well as on a mini van and the door of the mini van.

George said the Barney residence was put under surveillance because no one answered the door when he and his supervisor attempted to contact the suspect. Lights reportedly came on in the residence at 6 a.m., and Barney was finally contacted at about 7 a.m.

Under cross-examination by defense attorney Mike Cornia, George stated Skaggs said she was hit with a baseball bat. No baseball bat was found at the scene, and no search warrant was served or executed at the Barney residence, according to George.

Judge Michael L. Greer said he found probable cause in the evidence to bind the case over to Third District Court for further proceedings. No arraignment date was set during Barney’s circuit court appearance.
