Evanston’s John Weber in court on assault charges

EVANSTON — On Dec. 14, John D. Weber, of Evanston, appeared in Uinta County Circuit Court for a preliminary hearing before Judge Michael L. Greer. Weber is charged with one count of aggravated assault with a drawn, deadly weapon.

Prosecutor Dean Stout called the investigating officer to the stand as his first witness. Wese testified he reported to a call on Hayden Street at about 8 p.m.The officer stated the call was for violation of a protection order, but the call was updated to shots being fired as the officer arrived on the scene.

A .22 caliber pistol was found at the scene. Officer Wese stated he was told one of the witnesses knew who the shooter was, and when he asked for that name, the witness said, “My brother.” A .22 shell casing was also allegedly found at the scene and given to police.

Defense attorney Devon Peterson called a 16-year-old minor to the witness stand.

“The Pryor family was trying to kick down our door. I believe John [Weber] felt very threatened. Everybody was approaching John. I heard a shot,” the witness testified.

It was alleged Weber fired the gun, and told police he had done so.

The case was bound over to Third District Court as a felony. Bond was set at $20,000 cash or surety.
