Couple faces heroin delivery, conspiracy charges Jan. 31

EVANSTON On Jan. 31, Rachelle Bell of Florida was in Uinta County Circuit Court for a preliminary hearing on felony charges of possession of heroin with intent to deliver, delivery of heroin, and conspiracy to deliver heroin.

It was alleged Bell and her live-in boyfriend, Michael Hart, sold heroin through the rear window of their motel room on Harrison Boulevard in Evanston on Jan. 17.

In testimony, a Department of Criminal Investigation officer stated the premises was under surveillance, and that controlled buys were conducted with three confidential informants, one of whom was wearing surveillance equipment.

It was further alleged Bell implicated Hart in the sale of the drugs during interrogation at the Evanston police station.

Michael Hart did not appear in court, but the testimony included his name on numerous occasions.

It was stated the couple were selling $700 to $1,200 of heroin every two days beginning in November 2012.

The officer testified information began to come in on Jan. 15, and the interviews at the police station were conducted Jan. 17. A search warrant was issued and executed while Bell was in custody; 5.6 grams of heroin, packaging supplies for the drug and identified money from controlled buys were all found at the scene.

The officer also testified Bell and Hart both admitted to using heroin during their interviews. During questioning, the officer stated Hart said in interviews he started using heroin in Noveber 2012 after receiving the drug from a coworker at the Evanston Taco Bell.

Judge Michael L. Greer found sufficient probable cause to bind all three charges over to Third District Court. No court date has yet been set.
